Terms & Conditions

Frantoio Gaudenzi (VAT: PI 02478450543, hereafter “the Company”), located in Trevi Fr. Pigge voc. Camporeale 06039, informs the Customer that relations between the Parties (the Company and the Customer) regarding the sale of products (“Products”) on frantoiogaudenzi.it (“the Site”) are governed by the terms and conditions outlined here. These General Conditions of sale are integral to every offer, purchase order, order confirmation, or transaction of Products on the Site. The updated version is available on the Site. The Customer is exclusively the Consumer as per art. 3, lett. a), D. Lgs. 6 settembre 2005, n. 206 (Consumer Code), acting for purposes outside their business or professional activities.
The Customer acknowledges that information regarding the essential characteristics of Products, including prices, can be found on the Site within each Product sheet.
Products are purchased via Customer orders placed through the Site (“Order”). The Customer must fill out the electronic order form, providing necessary identification, ordered Products, quantities, delivery address, and payment methods. Accurate and truthful data is required. The Customer must submit the completed Order to the Company electronically, following the instructions provided on the Site. Before purchasing, the Customer agrees to read these General Conditions, displayed during the Order registration process, and accepts them by marking the appropriate space on the Site. The Customer agrees to review essential Product features, prices, payment methods, delivery costs, withdrawal rights, and return times. After completing the online purchase process, the Customer should verify and correct data errors, print and retain the Order and General Conditions, or save/replicate a copy. The Order will be stored in the Site’s database for processing. The Customer can access their Order via “My Orders” on the Site. The Company sends an Order receipt confirmation to the Customer’s email provided during Order submission, summarizing Order details, General Conditions, essential Product features, price and payment, delivery methods and costs, contact methods, and withdrawal rights. This communication serves as the Company’s acceptance of the Customer’s contractual proposal via the submitted Order, forming the contract between the Parties. The Company will promptly notify the Customer of any Product unavailability and refund any payments. By transmitting the Order, the Customer confirms knowledge and acceptance of the General Conditions and Site information, including the order process, Privacy Policy, and Returns and Refunds information. After the first purchase, the Customer can use “Quick Purchase” to save their delivery address for future purchases, as specified on the Site during the Order process.

Prices on the Site for each Product are in Euros, include VAT, and are valid when the Customer sends the Order. Shipping costs, described in article 5, are added to the Order total. For delivery outside Italy, the Customer is responsible for taxes or duties as per the destination country’s laws.
Fiscal documentation is issued when Products are shipped to the Customer. Payment methods on frantoiogaudenzi.it include:

5. Credit card payments are processed via Nexi with maximum security assurance. Payment data is protected using advanced technology and encryption (SSL), specifically VeriSign certificates ensuring high e-commerce security. Using a credit card online is as secure, fast, easy, and reliable as shopping in physical stores. Payments on the site are further secured by Verified by Visa and MasterCard Secure Code systems, ensuring that the customer and retailer are legitimate payment holders through an additional password, enhancing purchase security.

The Company delivers via trusted courier (UPS or equivalent) within Italy and the EU to the address specified in the Order, provided the information is accurate and complete. Deliveries in Italy occur Monday to Friday, excluding holidays, typically within 4/5 business days from Order acceptance, barring force majeure or unforeseeable events. Orders accepted after Thursday at 12:00 or on Friday will be processed by the courier on the following Monday to maintain Product integrity. If the Customer is absent during the first delivery attempt, the courier will attempt delivery two more times before returning the Products to the Company. Given some products’ perishable nature, the provided address should be one where someone is available to receive the package. Shipping details for EU countries outside Italy differ and are detailed on the Site under “Shipping Times and Costs.” This document, which the Customer agrees to read, contains additional specifics regarding Italian deliveries. Upon delivery, the Customer should verify the package’s integrity and the number of packages against the delivery document. If altered or if the package lacks “Frantoio Gaudenzi” branding, the Customer should refuse delivery, citing “Tampered Package.” Any damages or discrepancies must be reported with a “conditional acceptance” on the courier’s delivery proof to retain rights for future claims. The Customer can track Order delivery times and status via the courier’s website using the tracking number provided in the Company’s acceptance email. Delivery costs are borne by the Customer unless otherwise specified on the Site as a promotion, detailed in Shipping Times and Costs on the Site and in the Order form.

The Customer may request Product replacement if damaged during transport, provided they made the “conditional acceptance” noted in article 5. This right must be exercised within five (5) business days of receipt by emailing info@frantoiogaudenzi.it. The Company will send replacements via its courier at no additional cost within a reasonable time.
The Customer may withdraw from the Contract without penalty and without specifying a reason within 15 business days from receiving the Products. Customers in Italy may return Products at their expense within fifteen (15) days, provided they are unused and intact. The Company will refund payments within fifteen (15) days from withdrawal notification. Products must be returned intact, unused, in their original packaging or a new sealed package, to the courier within fifteen (15) business days of receipt. Return shipping costs are the Customer’s responsibility. The Customer must hand the prepared package to the courier and notify the Company of withdrawal via email to info@frantoiogaudenzi.it within the same 15-day period. For deliveries outside Italy, return costs are the Customer’s responsibility. For more return information, contact info@frantoiogaudenzi.it. If withdrawal is exercised per the terms, the Company will refund via credit card or PayPal within fifteen (15) days. If withdrawal terms are not met, the Customer is not entitled to a refund. The Company will notify the Customer via email if the return is non-compliant. The Customer acknowledges that withdrawal is void if Product integrity (packaging or content) is compromised, if the original packaging is missing or damaged, or if essential Product elements are missing. The Customer also acknowledges withdrawal is not available for highly perishable Products that risk alteration or deterioration due to their nature.
The Customer, aware of legal penalties for false declarations, declares they are a Consumer as described above, of legal age, and that the information provided is correct and truthful.
The Customer acknowledges and has reviewed the personal data processing information by clicking the Privacy Policy link. The Customer acknowledges that this document forms part of these General Conditions, deemed accepted upon Order submission.
The nullity of any clause of these General Conditions does not nullify the Conditions or the entire sales Contract, but the null clauses will be replaced by mandatory rules.
These General Conditions and any Customer purchase on the Site are governed by Italian law. For disputes regarding these General Conditions, the jurisdiction is the Customer’s residence or elected domicile in Italy. If the Customer’s residence or domicile is outside Italy, the jurisdiction is Rome. The Customer may seek dispute resolution via mediation or alternative dispute resolution bodies.
